Remedial resources

An appeal against the decision of the obligatory person regarding the refusal for the required information can be submitted in a period of 15 days from consignment of the decision or the expiry of the period for the decision regarding the application, when from the day of the consignment of the decision is considered the third day from the expiry of the period in dispatching the application. Appeals are to be submitted to the obliged body, which issued the decision or had to issue – i.e. the Customs Directorate of the Slovak Republic, the Customs Criminal Office or the relative Customs office. The appeal of the obliged body is decided by the superior obliged body, which in matters it decided or had to decide, i.e. should it be the Customs Criminal Office and the Customs offices, is it relevant that the Customs Directorate of the Slovak Republic examines the decision, should the appeal be against a decision of the Customs Directorate of the Slovak Republic the relevant body for its examination is the Minister of Finance of the Slovak Republic.

The decision regarding the refusal of the application can be examined in a judicial procedure according to paragraph 244 and the following of the Civil ordonnance.

Procedures for the handling of applications about information

The obliged body is to handle applications regarding the provision of information without needless delay, at the latest within eight working days from the day of the submission of the application or from the day of the elimination of the shortcomings in the application.

The obliged body can extend the period for the handling of the application, at the most to eight working days should serious reasons arise. The Serious reasons are:

  1. searching and gathering of the required information is at other places, other than the residence of the obligatory person handling the application,
  2. searching and gathering  of a larger amount of separate or different information required for access in one application,
  3. documented technical problems connected with investigation and access to information, about which it is possible to presume their possible elimination in the sphere extension of the period.

The obliged body announces to the applicant without delay the extension of the period, at the latest before the expiry of the period for handling the application. In the announcement lists the reasons which led to the extension of the period.
